Terms of Service
These Terms of Service are an agreement between you and TowerBid (“TowerBid,” “we,” “us”) for the marketplace at tower-bid.com. We are a Florida-based business. Contact invites@tower-bid.com. A street address and registration number are not published on this page.
You accept these terms when you create an account, check the agreement box during setup, submit a bid, or otherwise use TowerBid. If you use TowerBid for a company, association, or board, you confirm that you can bind that organization, and “you” includes both you and that organization.
The Privacy Policy at /privacy explains how TowerBid handles personal information. It is part of this agreement. Plan prices and limits shown on the plans page are part of a vendor’s subscription.
You must be at least 18 years old and able to enter a contract. TowerBid is a tool for building management and service contractors, used in a business capacity.
Sign-in uses an email address and a password. You may be asked to confirm the email address before the account is active. You are responsible for activity under your login and for keeping the password confidential. Tell TowerBid at invites@tower-bid.com if you believe the account is being used without permission.
During setup you create one organization and choose its role: a buyer or a vendor. The person who completes setup is the organization owner. Use accurate organization and contact details, and keep them current.
Buyers are building owners, property managers, condo and HOA boards, developers, and similar organizations. Buyers add buildings, post requests for proposal, invite vendors, read bids after they unseal, compare them, and award one. Buyers use TowerBid without a subscription fee.
Vendors are service contractors. Vendors keep a profile, upload compliance documents, receive invitations, ask questions, and submit sealed bids on work they were invited to. Vendors pay a subscription. TowerBid does not charge a commission, a success fee, or a per-lead fee, and a vendor keeps the contract price agreed with the buyer.
Platform administrators are accounts TowerBid designates with the admin role. They are not a third kind of customer. Administrators review the buyer verification queue, review vendor compliance documents, and handle support tickets. Administrator access is described in the sealed-bid section and in the Privacy Policy.
TowerBid provides software for posting scope, inviting vendors, collecting sealed bids, comparing them, and recording an award. The contract for the work is between the buyer and the vendor. TowerBid is not a party to that contract, does not negotiate it, and does not sign it.
An award on TowerBid records the buyer’s selection and, if the buyer confirms it, a contract start date for the audit trail. Payment for the work is between the buyer and the vendor. TowerBid does not collect, hold, or pay the contract price.
TowerBid does not perform construction or building services, does not supervise the work, and does not guarantee that work will be started, finished, paid, or free of defects. TowerBid is not a licensed contractor and is not an insurance, real-estate, or procurement broker. A document marked verified, and a buyer organization marked approved, means a TowerBid administrator completed a review. It is not a warranty of licensure, coverage, solvency, or fitness for a particular building.
Until the buyer’s deadline, bid amounts, pricing units, schedules, validity periods, notes, and bid attachments stay sealed from the buyer. After the deadline, the request unseals. The buyer can then open each bid, compare the bids, and award one. Until a bid is opened, its price and notes stay hidden from the buyer. Vendors may edit or withdraw their own bid only before the deadline. Submissions close when the deadline passes.
A vendor can see its own bid. A vendor cannot see another vendor’s bid. Do not attempt to view, infer, or obtain another vendor’s price, notes, or attachments, and do not attempt to read bid contents before the deadline.
Questions and answers work alongside the seal. The buyer can see which vendor asked a question. When the buyer publishes an answer, invited vendors can read the question and the answer, and other vendors do not see the asking vendor’s name. Unpublished questions stay between the asking vendor and the buyer.
Vendor directory details are separate from the bid. A verified buyer can see a vendor’s name, trades, markets, plan, description, website, contact email, meeting link, photo, win count, and founding badge while bids are still sealed. That contact information is for reaching the vendor. It does not open the bid.
People who hold a TowerBid platform admin account can access records as needed to operate, secure, and support the service, including procurement records and compliance files. That access is for operating TowerBid. It does not let a buyer read a sealed bid, and it does not let a vendor read a competitor’s bid.
Buyers and vendors will use bid contents, questions, and compliance files only to evaluate, award, and carry out the work, and to meet legal duties. The buyer can download an audit record of its own request. That record can include the scope, the building, invitations, questions and answers, bids the buyer is allowed to see, the award, and related audit events.
Describe your company, trades, and markets accurately. Bids are by invitation. You bid only on work your organization was invited to.
Before you can submit a bid, the compliance vault must hold a certificate of insurance that is not expired, a contractor license that is not expired, and a W-9. You may also upload a bond letter. You are responsible for keeping those credentials current and for carrying the licenses and insurance the work and the law require. A bid can be refused when a required document is missing or expired.
Documents you upload must be genuine and must describe your organization. TowerBid may review a document and mark it verified after that review. Verification is a record of the review. You remain responsible for the truth of the document and for your eligibility to do the work.
Stand behind the bid you submit, including the price, schedule, and the validity period you enter. After an award, the winning vendor’s vault documents, including the files, are shared with that buyer. Other bidders’ vault files are not shared because of the award.
Post work you are authorized to procure for the building. Describe the building and the scope in good faith, and say so when a budget figure is only an estimate. You can hide the budget from vendors.
New buyer organizations can draft buildings and requests while TowerBid reviews them. Until that review is approved, the organization cannot publish a request, invite vendors, or open the vendor directory. TowerBid can refuse a buyer organization and does not promise a review time.
Respect the seal. Do not try to learn bid contents before the deadline, and do not use a buyer account to collect competitors’ prices. When you award, you are choosing the vendor. You are responsible for the contract you make with that vendor, including payment and the scope of work.
When you answer a vendor’s question and publish it, the answer goes to the vendors invited to that request. Publish answers that other bidders would need so the process stays even.
Buyers are not charged. Vendors pay a subscription in U.S. dollars. The subscription is the only fee TowerBid charges a vendor. There is no commission, success fee, or per-lead fee on a win or a loss.
Current plans, as shown on the plans page: Starter is $99 per month and includes 3 bids per calendar month, 1 trade category, and 1 market. Pro is $175 per month and includes unlimited bids, 3 trade categories, and 2 markets. Enterprise is $250 per month and includes unlimited bids, all trade categories, all markets, and priority support as described on the plans page. Enterprise also offers an annual price of $2,500, paid up front and renewing each year. The plans page describes that annual price as two months free compared with paying Enterprise monthly.
A Starter bid counts against the monthly cap when it is submitted on a distinct request. Updating a bid you already submitted on that request in the same month does not use another bid. A withdrawn bid is not counted. The Starter cap is applied when the bid is submitted.
The first 50 vendor organizations whose subscription becomes active, or enters the monthly free trial, are Founding Vendors. A Founding Vendor is shown a badge that buyers can see, and is on founding-tier pricing: the subscription price in effect when that subscription starts does not increase for as long as the vendor remains continuously subscribed. Vendors after those 50 pay the plan prices in effect when they subscribe. Later prices may change. Founding-tier pricing follows the description on the plans page.
A vendor is required to keep a subscription in order to keep using vendor features. When a subscription is on the account, bid submission is available while the subscription is in a free trial, active, or inside the grace period in the next section. After the grace period, or after the subscription ends, bid submission is suspended until the subscription is in good standing again.
Vendor checkout and the billing portal are hosted by Stripe. You enter payment details on Stripe’s pages. TowerBid stores a Stripe customer id and the subscription’s plan, billing interval, status, and period end. TowerBid does not store card numbers. Checkout collects a billing address. If sales-tax collection is turned on, Stripe calculates the tax and adds it to the charge.
Monthly plans include a 7-day free trial. The trial starts without a payment card. Nothing is charged during the trial. If you do not add a card before the trial ends, the subscription ends. The annual Enterprise plan is paid at the start and does not include a trial.
Subscriptions renew automatically, monthly or yearly depending on the plan, until you cancel. You can update the card, change plans, view invoices, and cancel from the billing portal linked on the plans page. Cancellation stops the next renewal. The subscription remains in place through the end of the period already paid for.
Subscription fees are paid in advance for that period. TowerBid does not refund the unused part of a period, except where the law requires a refund.
If a renewal charge fails, you have 7 days from the first failure to update payment. During those 7 days you can still submit bids. After the 7 days, bid submission stays suspended until the subscription is in good standing.
Use TowerBid for sealed-bid procurement of building services. You will not probe or bypass the seal, the access rules, or billing. You will not register a buyer to fish for competitors’ prices, misstate who you are, or upload documents that are not yours. You will not upload malware, interfere with the service, scrape it, or send spam through invitations, questions, or support.
You will not use another organization’s account, or share a login, in order to avoid a plan limit. You will follow the law that applies to your procurement, your licenses, and your insurance.
You keep ownership of the content you submit: organization profiles, building details, scopes, bids, messages, photos, and files. You give TowerBid a non-exclusive license to host, display, transmit, and share that content as the product operates. That includes showing a request to invited vendors, showing a bid to the buyer after it is unsealed and opened, showing a directory profile to verified buyers, sharing the winning vendor’s compliance documents with the awarding buyer, sending operational email, and producing the buyer’s audit record.
You confirm that you have the rights needed to submit the content, and that sharing it as this agreement describes does not violate someone else’s rights. TowerBid may remove content that breaks these terms or the law.
A buyer may use the scope writer to turn a plain-language description into a draft request. The building name, city, size, and the description you type are sent to Anthropic so it can return a draft title, category, scope, requirements, budget range, and a suggested deadline. You can edit the draft before anything is published. You decide what to publish.
Drafts can be incomplete or wrong. They are not engineering, legal, insurance, or cost advice, and they are not a promise that a price or a specification is appropriate for the building. Review every draft against the building and the work before you publish it. TowerBid does not warrant the draft.
TowerBid runs on other companies’ services. Hosting and the daily scheduled job run on Vercel. Sign-in, the database, and file storage run on Supabase. Subscriptions run on Stripe. Operational email is sent with Resend from invites@tower-bid.com. The scope writer calls Anthropic. Those providers process information under the Privacy Policy and under their own terms.
TowerBid does not control those providers. A failure or change on their side can interrupt sign-in, storage, email, billing, or the scope writer. Where the law allows, TowerBid is not liable for their outages beyond the limit in the liability section.
TowerBid owns the service, the software, the TowerBid name, and the look of the product. These terms give you a limited right to use the service while your account is in good standing. You do not receive any ownership in the service. You will not copy the product, misuse the name, or reverse engineer the service except where the law expressly allows it.
The service is provided as available. To the fullest extent Florida law allows, TowerBid disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and disclaims any warranty that the service will be uninterrupted, that a bid will be invited or awarded, that a vendor is qualified, that a verified document or an approved buyer is what it appears to be, or that an AI draft is accurate.
Procurement decisions are yours. You are responsible for independent judgment about scope, price, credentials, and the contract you sign with another user.
To the fullest extent Florida law allows, TowerBid is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost contracts, or lost data, even if advised that they were possible.
TowerBid’s total liability arising out of the service or these terms is limited to the greater of the subscription fees you paid TowerBid in the twelve months before the claim, or one hundred U.S. dollars ($100). This limit does not apply to a payment you owe TowerBid, or to liability that Florida law does not allow a contract to limit.
You will defend and indemnify TowerBid and its directors, employees, and agents against claims, damages, and reasonable expenses (including reasonable attorneys’ fees) arising out of your content, your bids, your credentials, the contract you make with another user, your use of the service, or your breach of these terms. We will give you notice of a claim when it is practical to do so. You do not have to indemnify us for our own fraud or willful misconduct.
You may stop using TowerBid at any time. A vendor cancels a subscription in the billing portal, and cancellation takes effect as the billing section describes.
TowerBid may suspend or close an account, refuse a buyer organization, or remove content if you break these terms, if a subscription stays unpaid after the grace period, if a verification review fails, or if the use creates a security or legal risk. Where it is reasonable, TowerBid will tell you why.
When the agreement ends, the license to use the service ends. Sections that by their nature should continue stay in effect, including marketplace role, confidentiality of information already shared, payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, Florida law, and dispute resolution. Procurement and audit records may be kept as the Privacy Policy describes.
These terms are governed by the laws of the State of Florida, excluding conflict-of-law rules that would apply another state’s law.
Before filing a claim, send a short description of the dispute and the relief you want to invites@tower-bid.com. The parties will use 30 days from that notice to try to resolve it informally. Either party may skip this step if waiting would leave a right time-barred.
If the dispute is still open, either party may bring it in the state or federal courts located in the State of Florida. You consent to personal jurisdiction in those courts. Each party keeps any right to a jury that the law provides. This section does not require arbitration.
TowerBid may update these terms. The new version and its effective date will be posted on this page, and the version identifier will change. If you continue to use TowerBid after the effective date, you accept the updated terms. Submitting a bid records the version in effect at that time, along with the acceptance recorded at setup.
If you do not agree to an update, stop using the service and cancel any subscription before the effective date. The billing section still governs fees already due.
Questions about these terms: invites@tower-bid.com. That is the address on TowerBid’s account and invitation mail. If you are signed in, you can also open a ticket under Help. Write to us at that email. No separate registered-office address is published on this page.
These terms and the Privacy Policy are the entire agreement between you and TowerBid about the service. If a court holds one part unenforceable, the rest stays in effect. Waiting to enforce a right is not a waiver. You may not assign this agreement. TowerBid may assign it in connection with a merger, financing, or sale of the business, or to an affiliate.
